Doesn't justify what he did. The poke was battery on a LEO, but pretty damn minor. Could have gone hands-on and cuffed him. The bitch slap (while funny) was out of line and unprofessional.
Hell, even MLB umpires have enough self control to take a poke or shove without retaliating, and those moments can get a lot more heated than what we saw in this video.
Justified, yes. Legal, maybe not. If it was an instant reaction, I think it would be different. He waited a pretty good amount of time before retaliating. I'm not sure how that works though.

The guy made contact the first time, and got near to it a second. He's actually lucky to have gotten just the slap. That officer would have been within his rights to give a much more violent take down.
